Terms of Service

1. Acceptance

By using GetXMP ("Service"), you agree to these Terms. If you do not agree, do not use the Service.

2. Description of Service

GetXMP is a web-based tool that uses AI to analyze JPEG preview images and generate Lightroom-compatible XMP sidecar files. The Service is offered on a free (ad-supported), pay-per-photo, and subscription basis.

3. Eligibility

You must be at least 13 years old to use the Service. By using GetXMP you represent that you meet this requirement.

4. Acceptable use

You agree not to:

  • Upload images you do not own or have rights to process
  • Upload illegal, obscene, or abusive content
  • Attempt to bypass rate limits or abuse the free tier
  • Reverse-engineer, scrape, or automate the Service without permission
  • Use the Service in any way that violates applicable law

5. Payments & refunds

Bulk (pay-per-photo): Payments are non-refundable once XMP files have been generated and delivered.

Subscription: You may cancel at any time. Cancellation takes effect at the end of your current billing period. No partial refunds for unused days.

All payments are processed by Stripe. We do not store payment card details.

6. Intellectual property

You retain full ownership of images you upload and XMP files you download. We claim no rights over your content. The GetXMP name, logo, and interface are our property.

7. AI-generated output

XMP files are generated by an AI model (Anthropic Claude). Results are provided as-is. We do not guarantee specific aesthetic outcomes. Always review edits in Lightroom before finalizing your work.

8. Disclaimer of warranties

The Service is provided "as is" without warranties of any kind. We do not guarantee uninterrupted availability, error-free output, or fitness for a particular purpose.

9. Limitation of liability

To the fullest extent permitted by law, GetXMP shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months prior to the claim.

10. Termination

We reserve the right to suspend or terminate access to the Service at any time for violations of these Terms or for any other reason, with or without notice.

11. Governing law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of competent jurisdiction.

12. Changes to terms

We may update these Terms at any time. Continued use after changes constitutes acceptance. Material changes will be noted with an updated date.
